Asset and portfolio management
FinTechs belonging to this category offer asset and portfolio management services via an internet platform or software programs and usually manage and dispose of the assets of their customers long or short term according to their specifications without actually holding the property or the possession of those assets. FinTechs, which provide information about and access to overnight or time deposit accounts at national and foreign banks and which execute the transactions to these accounts, also belong to this category.  Some FinTechs however only act on request of the customer.

Aside from that some FinTechs offer software or internet solutions enabling users to manage and plan their personal finances on their own by providing graphics, overviews and compilations of their financial data and sometimes indicating financial risks or opportunities, but without actually managing the assets.

Attitude of the country towards modern asset and portfolio management services

Applicable legislation in BiH regulates portfolio management, whereas asset management is not subject of regulation. The relevant regulators are securities commissions in FBiH and RS.

Legal affairs

Obligations and requirements to provide asset and portfolio management, or ancillary services described above

Applicable legislation in BiH recognises portfolio management as custody services, while asset management is still not recognised under BH law. Applicable legislation under provision of custody services recognises provision of the following services: (i) securities custody services; (ii) transaction settlement services; (iii) revenue collection; (iv) corporate actions and client representation; (v) reports on transaction, settlement, and execution; (vi) purchase and safekeeping of bonds of foreign countries and foreign companies; and (vii) providing information on domestic capital markets. The custody services can be performed only by banks and in order for the banks to become qualified, they need to fulfil certain conditions such as obtain permit issued by competent securities commission. The bank performing custody services is also required to enact the general terms and conditions specifying tasks that the custodian may perform for the client, description of the bases and manner of execution of tasks, manner of execution of the orders etc., which represent an integral part of all agreements concluded for provision of custody services.
