The EUCJ Decides on ART. 18 EUTMR (Transfer of an EU Trademark) - ShowerGreen Ruling

In the Law Firm of Gimenez Torres we are happy today since the Court of Justice of the European Union has given the reason to our client in the Judgment SHOWERGREEN, which interprets art. 18 of the EUTMR.

In defence of the interests of our client, the undersigned initiated an action claiming ownership of a registered EU trademark before the EU Trademark Court of Spain. In the first instance, it was considered that it was not possible to claim ownership of a EU trademark, but for the cause typified in art. 18 EUTMR (agent mark).
