Clare joined Philip Lee as a partner in 2015 from one of the top 5 law firms in Dublin.
Clare practices in both contentious and non-contentious construction law, advising employers, contractors, designers, public authorities and private entities. She specialises in dispute resolution and health and safety law.
Clare has over 10 years’ experience in high value complex disputes. Her litigation experience ranges from High Court to Commercial Court, from Court of Appeal to the Supreme Court. She has repeatedly managed judicial review challenges to high value procurement decisions issued by state authorities.
She has vast experience in alternative dispute resolution, having worked at all stages of mediation, conciliation and arbitration, advancing disputes from preliminary meetings through to hearings and pleadings, up to the issue of recommendations and awards. As adjudication enters the Irish ADR scene with the Construction Contracts Act 2013, Clare is among a handful of lawyers uniquely positioned to embark on adjudication disputes.
In addition to her contentious practice, Clare is highly experienced in commercial drafting and negotiation. She has acted for state authorities on large scale infrastructure projects, managing negotiations and bringing the projects to successful close, with risk management, problem solving and detailed specialist advice.
Clare has developed a particular expertise in health and safety law and routinely provides regulatory advice on procedures to be adopted in abiding by the statutory regime imposed by the Safety Health and Welfare at Work legislation, regulations thereunder and the Building Control Acts. She acts in litigious applications pursuant to such legislation, in appeals of Prohibition Notices issued by the Health and Safety Authority (HSA), advice in the light of Commission for Energy Regulation (CER) interviews and acting for directors in relation to investigations.
