Sean is a partner with Philip Lee specialising in technology, intellectual property, ICT procurement, data protection and privacy law.
Sean’s practice spans those business sectors where technology plays a key role, in respect of both contentious and non-contentious matters.
On the technology side of Sean’s practice, he advises clients in relation to IT outsourcing and services arrangements, systems implementations, cloud computing, data protection and intellectual property. On the commercial contracts side of Sean’s practice he typically advises in relation to agency, distribution and franchising agreements.
Sean also has significant experience of public procurement particularly relating to IT projects – he acts for both public sector contracting authorities and private sector bidders. Sean’s unique background gives him an edge as an advisor in ICT procurements as he understands and speaks the technical language as well as the legal.
Sean regularly advises clients on all software licencing issues and is currently acting for the HSE in proceedings taken by one of its largest software vendors for breaches of software licences and breaches of copyright.
Sean also advises clients on the supply and implementation of new IT systems, the licensing of software and the ownership and licensing of intellectual property rights.
He frequently advises clients on compliance issues in respect of website developments such as privacy/data protection issues and general terms and conditions.
Sean regularly acts for companies in disputes relating to screen-scraping, misuse of Google search rankings and of Google AdWords, trade mark infringement, passing-off and breach of website terms and conditions.
